2Applicability

1. These terms and conditions apply to all offers, orders, agreements, deliveries and payments of Velvet Cakes by Anka.
2. By placing an order the customer declares that they agree to these terms.
3. Deviations are valid only if they have been agreed in writing.
4. If a provision proves to be invalid, the remaining provisions remain in full force.

3Offer and prices

1. All prices are in euros and include VAT, unless stated otherwise.
2. Prices are subject to change as a result of rising ingredient prices or changes in the law.
3. Photos of products are indicative; handmade products can differ.

4Orders

1. Orders can be placed by email, WhatsApp, social media or through the website.
2. An order is final as soon as it has been confirmed.
3. Custom orders go into production only after a deposit of 30% has been paid.
4. Changes are possible only by arrangement and can involve extra costs.
5. Orders at short notice can be refused.

5Delivery and collection

1. Orders can be collected by appointment or delivered.
2. Delivery costs are communicated in advance.
3. Delivery times are indicative.
4. On collection the risk passes to the customer.
5. With delivery the responsibility continues until hand-over.

6Storage advice and liability

1. The customer is responsible for storing the product correctly.
2. Damage caused by incorrect transport or storage is at the expense of the customer.
3. Velvet Cakes by Anka is not liable for indirect damage.

7Right of withdrawal and cancellation

Please note: perishable products are excluded from the right of withdrawal by law (art. 6:230p of the Dutch Civil Code).

Cancellation terms

• 4 days or more in advance: 100% refund
• 2 to 3 days in advance: 50% refund
• 2 days or less in advance: no refund
• Cancelling during the production process is not possible

8Complaints

1. Complaints must be reported within 3 hours of collection or delivery.
2. Complaints must come with photos and a clear description.
3. Where needed, a suitable solution is offered.

9Payment

1. 30% of the payment is due after the order has been confirmed.
2. 70% of the payment is due on collection or delivery.
3. If payment is not made on time the order can be cancelled.

10Force majeure

1. In the event of force majeure the order can be cancelled or moved to another date.
2. The customer receives a refund or a replacement date.

11Privacy

1. Personal data is used solely for processing orders.
2. Data is not shared with third parties except where this is necessary.

12Retention of title

1. Products remain the property of Velvet Cakes by Anka until payment has been received in full.

13Governing law

These terms are governed by Dutch law.
